Facing the Crisis

Call the Lender

In fixing bad credit, talking straight with the creditor is of paramount importance and one that can play the most crucial role in tiding over the bad debt problems. Calling the lender though not amusing can be to the benefit of the borrower.

It is to be remembered that the creditor is more interested in recovering the credit and continuing the business rather than engaging a bill collector at high cost. Keeping this mindset of the creditor in mind, the borrower can with some diplomatic persuasion get a modified repayment program making management of the bad debt easier.

Knowledge is Strength

Visits and calls by debt collectors often make the debtor feel harassed. If the debtors know their rights they can battle it out and get saved from such harassment. The debtor has the right not to be contacted by the debt collector after 9 pm or before 8 am.

Neither the debtor nor his relatives can be harassed by the debt collector. Sometimes the debt collector threatens the borrower with imprisonment which is a blatant lie to be ignored since federal law does not permit imprisonment just because one is unable to pay off a debt.

The threat by the bill collector of attaching wages is also specious as in USA wages cannot be attached without legal proceedings. Whenever a debt collector is found to be calling the debtor or making visits at his office, the debt collector can be straightaway advised in writing to stop such calls or visits at workplaces of the borrower.

The debt collectors who create troubles can be counter-threatened by the debtor with legal action only if the debtor is aware of all these rights. Once the collector realizes that the debtor is aware of the rules, harassment stops. Federal Trade Commission can also be contacted online for information on handling harassing debt collectors.

Federal Laws

Federal laws protect the borrowers against harassment by lenders or debt collectors. One only needs to be aware of the laws and rights.
